Terms of Service & Refund Policy
These Terms of Service (“Terms”) govern your access to and use of the “For The Record” platform and all related services provided by PolicyShift.ca Inc.(“PolicyShift,” “we,” “us,” or “our”). By accessing the platform, purchasing a report, or subscribing to our services, you agree to be bound by these Terms.
Nature of Service
PolicyShift.ca Inc. provides a civic technology platform that tracks, documents, and organizes the policy positions of Canadian Members of Parliament (“MPs”) and other elected officials. Our service is designed to provide transparency by presenting direct quotes and position timelines. The information provided is for educational and informational purposes only.
Eligibility and Permitted Use
PolicyShift.ca Inc. grants you a limited, non-exclusive, non-transferable, and revocable license to access our data under the following conditions:
- Permitted Users: This service is available to Canadian citizens for personal research and to small-scale non-governmental organizations (e.g., local taxpayer alliances, community advocacy groups).
- Prohibited Users: Use of this platform, its data, or its reports by the following entities is strictly prohibited without a separate, written Enterprise License Agreement:
- Major news organizations and media outlets (e.g., CBC, national newspapers).
- Governmental agencies, departments, or crown corporations (e.g., Government of Canada).
- Large commercial corporations (e.g., Apple Inc., or similar multinational entities).
- Purpose: Use is restricted to personal informed voting, academic research, and non-commercial community advocacy.
Prohibited Conduct and Anti-Scraping Policy
The integrity of our data and technical infrastructure is paramount. By using the service, you agree to the following:
- No Scraping/Botting: You are strictly prohibited from using any automated means (including bots, scrapers, spiders, AI crawlers, scripts, or similar tools) to access the platform or harvest data for any purpose.
- No Unauthorized API Use: You are strictly prohibited from attempting to bypass the user interface to access, probe, or use backend APIs, endpoints, or data streams. Unauthorized use of PolicyShift.ca Inc.'s backend APIs is a violation of these Terms and will result in immediate termination of access (and may result in legal action).
- No Redistribution: You may not sell, rent, sublicense, or otherwise redistribute the reports or data provided through the paywall to third parties.
Fees, Subscriptions, and Payments
PolicyShift.ca Inc. offers both one-time report purchases and recurring subscription plans.
- One-Time Purchases: Fees for individual "Response Reports" are charged at the time of purchase. Access is granted immediately upon successful payment.
- Subscriptions: Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless cancelled by the user prior to the renewal date.
- Price Adjustments: We reserve the right to change our pricing at any time. Any price changes to recurring subscriptions will be communicated with reasonable notice.
Refund Policy
Due to the digital nature of the content provided:
- All Sales Final / No Refunds: All sales are final. No refunds will be issued for one-time report purchases or subscription fees once access to the paid content has been granted.
- Cancellation: You may cancel your subscription at any time; however, you will continue to have access to the service through the end of your current billing period. No pro-rated refunds will be issued for unused portions of a subscription term.
Disclaimer of Accuracy and Liability
While PolicyShift.ca Inc. strives for the highest level of accuracy in documenting politician positions:
- Data Accuracy Disclaimer (Best-Efforts / As-Is): "For The Record" provides data on a best-efforts basis. All data is provided "as is" and "as available." We do not guarantee the absolute accuracy, completeness, or timeliness of political positions, quotes, source material, or any derived summaries.
- No Professional Advice: The content on PolicyShift.ca does not constitute legal, financial, or professional political advice.
- Limitation of Liability: PolicyShift.ca Inc. is not liable for any decisions, actions, or outcomes based on the information provided through the platform. In no event shall PolicyShift.ca Inc. be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our platform.
Intellectual Property
All platform logic, UI/UX design, data-scraping logic, proprietary shift-indicators, and compiled databases are the sole property of PolicyShift.ca Inc. No ownership rights are transferred to the user upon purchase or subscription.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts in the Province of Alberta for any disputes arising out of these Terms.
Modifications
PolicyShift.ca Inc. reserves the right to revise these Terms at any time without notice. By using this platform, you are agreeing to be bound by the then-current version of these Terms of Service.
